1 Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the YARD mobile application ("App") provided by YARD Fitness ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not download, install, or use the App.

2 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial fitness purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code
• Remove, alter, or obscure any proprietary notices
• Use the App for any unlawful or unauthorized purpose
• Transfer, sublicense, or assign your rights to any third party

3 Purchases & Pricing

Prices are in USD and may vary by region. All purchases are processed through Apple App Store or Google Play Store.

4 Subscription Terms

The Rec Yard subscription is an optional auto-renewable subscription that provides access to competitive and social features.

To cancel your subscription:

Cancellation takes effect at the end of the current billing period. You will retain access to Rec Yard features until your subscription expires.

5 Refunds

All payments are processed by Apple App Store or Google Play Store. Refund requests must be submitted directly to the respective platform:

• Apple: reportaproblem.apple.com
• Google: Google Play refund page

We do not have direct access to process refunds for app purchases or subscriptions.

6 User Conduct

You agree to use the App responsibly and in compliance with all applicable laws. Specifically, you agree not to:

• Manipulate, falsify, or cheat workout data or leaderboard times
• Harass, abuse, threaten, or intimidate other users
• Post offensive, harmful, or inappropriate content in social features
• Attempt to gain unauthorized access to the App or its systems
• Use automated bots, scripts, or tools to interact with the App
• Circumvent any security or access controls

Violation of these rules may result in termination of your account and access to Rec Yard features without refund.

7 Intellectual Property

The App, including all content, features, functionality, graphics, user interface, and underlying technology, is owned by YARD Fitness and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

The YARD name, logo, "Flip. Move. Finish." tagline, and all related marks are trademarks of YARD Fitness. You may not use any of our trademarks without prior written permission.

8 Health & Safety Disclaimer

You acknowledge that physical exercise carries inherent risks. You assume full responsibility for any injuries, damages, or health consequences that may occur during or as a result of using the App. We are not liable for any personal injury or health issues arising from your use of the App.

9 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YARD FITNESS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11 Indemnification

You agree to indemnify, defend, and hold harmless YARD Fitness and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another party.

12 Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease.

Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive any termination of these Terms.

13 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App or on our website and updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the courts located in the United States.
